Recently, two of our veteran Illinois solid surface fabricator members were hit hard by the Illinois Department of Revenue (IDR). We are asking for your help to determine if these were simply two random events or if the IDR is targeting the solid surface fabricator and countertop makers of Illinois.
During what started out as two standard “luck of the draw” audits, in two companies not known or connected with each other, the IDR reclassified both companies, from “Manufacturer,” which they had been for many years, to “Construction Contractor.”
The reclassification triggered a series of rulings which voided their collection and use of Reseller’s Certificates from their dealers for the year in question, and made them liable to pay the Retailer’s Occupation Tax, not Use Tax. In addition they were now liable for the Nome Rule Tax. One of the two, a faithful tax paying citizens for many years got slammed for $67,000! The other is contesting the findings and does not know what the final bill will be. Did this happen to you?
ISSFA is it’s member’s advocate. If this is more than coincidence we want to uncover it and act appropriately in educating, defending and championing our members, and the Illinois countertop industry, in general. If it is found to be a fluke, even then we are there with up-to-date training and support so you are in compliance with the IDR. Either way, you, I and the other Illinois countertop makers need to know the truth – you need to know what’s going on and how to deal with it.
